8. Warranties and Disclaimers
8.1 Service Provided As-Is
Dayloom is provided on an “as is” and “as available” basis, without warranties of any kind, express or implied. This includes any warranty of merchantability or fitness for a particular purpose, warranty that the service will be uninterrupted or error-free, or warranty regarding the accuracy, reliability, or completeness of any content.
8.2 AI-Generated Content
AI-generated summaries, mood tags, and highlights are automated and not reviewed by humans. They may be inaccurate, incomplete, or misleading. They should not be relied upon for medical, legal, financial, or mental health decisions. Dayloom is not a medical device and does not diagnose, treat, cure, or prevent any condition. If you have concerns about your health, consult a qualified healthcare provider.
8.3 Uptime and Availability
We aim for 99% uptime but do not guarantee continuous or error-free service, availability during maintenance windows, data availability if your account is terminated for violations, or protection against data loss due to user error.
9. Limitation of Liability
9.1 Excluded Damages
To the maximum extent permitted by law, Dayloom, its founders, employees, and partners are not liable for loss of profits, revenue, data, or business opportunities; consequential or special damages arising from use or inability to use the service; damages from third-party services such as Supabase, Hack Club AI, or RevenueCat; or personal injury, property damage, or emotional distress related to journal content.
9.2 Liability Cap
Our total liability for any and all claims arising from your use of Dayloom shall not exceed the fees you paid to Dayloom in the 12 months preceding the claim, or $100 USD if you are a free-tier user. This limitation applies even if we have been advised of the possibility of such damages.
9.3 Jurisdictional Exceptions
Some jurisdictions do not allow limitations of liability. If applicable law in your jurisdiction restricts these limitations, they may not fully apply to you.
10. Indemnification
You agree to indemnify and hold harmless Dayloom, its founders, employees, and partners from any claims, damages, losses, or expenses — including legal fees — arising from your violation of these Terms, your violation of any law or third-party right, your use of Dayloom in a way that harms others, or content you upload or transmit.
11. Third-Party Services and Links
11.1 Third-Party Integrations
Dayloom uses third-party services to operate, including Supabase, Hack Club AI, and RevenueCat. These services are subject to their own terms and privacy policies. We are not responsible for third-party service outages, data breaches, or policy violations. Links to third-party policies are in our Privacy Policy.

12. Account Termination and Deletion
12.1 Deleting Your Account
You may delete your account at any time via Settings → About & Legal → Delete Account. Deletion is permanent and cannot be undone. Upon deletion, all journal entries, highlights, and metadata are removed from our database; your Supabase Auth account is deleted; and your user profile and subscription status are removed. We also attempt to delete all associated media files from storage.
Operational backups may retain deleted data for up to 30 days.
12.2 Termination by Dayloom
We may suspend or terminate your account if you violate these Terms, engage in illegal activity, have been inactive for 24 months, repeatedly exceed rate limits, or if we believe your account poses a security or legal risk.
Termination may be immediate and without notice for severe violations. You may request an explanation by emailing contact@dayloom.xyz.
12.3 Effect of Termination
Upon termination, your access to Dayloom is revoked, your data may be deleted, you remain responsible for any outstanding fees, and any bans are permanent.
13. Changes to the Service
We reserve the right to modify, update, or discontinue Dayloom or any of its features at any time, change pricing or features with reasonable notice (at least 30 days for major changes), and perform maintenance that may cause temporary downtime.
If we discontinue Dayloom, we will provide 60 days’ notice and assist you in exporting your data where technically feasible.
14. Changes to These Terms
We may update these Terms from time to time. Changes take effect immediately upon posting to dayloom.xyz/terms. For existing users, changes take effect 30 days after notice in-app or via email. Continued use of Dayloom after updates constitutes acceptance of the revised Terms. Major changes may require explicit consent before you can continue using the service.
15. Dispute Resolution
15.1 Informal Resolution
If you have a dispute, please email contact@dayloom.xyz with a description of the issue, your account email, steps to reproduce or relevant details, and the resolution you are seeking. We will respond within 30 days and make good-faith efforts to resolve the issue.
15.2 Arbitration (US Users)
If informal resolution fails, you and Dayloom agree that any legal action is subject to arbitration governed by the American Arbitration Association (AAA), taking place in the location where you reside. We will cover AAA filing fees and arbitrator costs; you pay your own attorney fees. Small claims court actions are permitted as an alternative.
15.3 Class Action Waiver
You agree not to participate in class action lawsuits against Dayloom. All disputes must be resolved individually.
15.4 International Users
If you are outside the United States, you may have additional dispute resolution rights under local law. These Terms do not waive any statutory rights you cannot waive by contract.
16. Governing Law
These Terms are governed by and construed in accordance with the laws of India, without regard to conflict-of-law principles. Your use of Dayloom constitutes consent to the jurisdiction and venue of courts in India. If you are in the EU, you may also bring disputes in your local courts.
17. Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.
18. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Dayloom and supersede all prior agreements, representations, and understandings, whether written or oral. No term is binding unless expressly stated in a written agreement signed by both parties.
